Minister Esther Dweck (Management and Innovation in Public Services) will publish an ordinance to extend the bidding law until March 2024, said this Wednesday morning (29) the mayor, Arthur Lira (PP-AL), at the March of Mayors, in Brasilia.

According to Lira, the minister’s intention is for managers to adapt to the new law and avoid losses with the application of the rule.

The new bidding law was sanctioned by former President Jair Bolsonaro (PL) in April 2021. The text modernizes the bidding rules in force, creates contracting modalities, requires guarantee insurance for large works, and inserts a new chapter in Penal Code, typifying crimes in bids with sentences of up to 8 years.

A Sheet sought the Ministry of Management to ask for details of the measure, but has not yet received a response.

In a speech to mayors, Lira spoke about the tax reform that is being discussed in the Chamber. “Everybody defends and wants the tax reform, but everybody wants the tax reform of their navel”, he criticized.

He defended that Congress approve the “possible tax reform at this moment” to minimize the problems of municipalities, states, the Union and the productive sectors of Brazil. In addition, he asked for commitment from the president of CNM (National Confederation of Municipalities), Paulo Ziulkoski, together with the mayors to help in the discussion of changes in the tax system.

Lira stated that the reform will not harm municipal interests. “On the contrary, we work for a reform that makes the distribution of resources between the municipalities fairer and that favors the development of all in a more equitable way.”

The president of the Chamber dedicated part of his speech to criticizing the excessive judicialization of laws by parties with little representation in the National Congress.

“Often, in a vote of 400 to 10, 400 to 20, 400 to 50, a single senator, a single party deputy enters with ADI [Ação Direta de Inconstitucionalidade] and, in the Supreme Court, it suspends the processing of a law, against an overwhelming majority that decided, discussed and voted in the National Congress”, he said.

He cited as an example the law of impropriety, which he called “draconian”.

“We left the military dictatorship for a dictatorship of the Public Prosecutor’s Office over the mayors of Brazil,” he said. Lira said that the old impropriety law kept good men and women away from politics.

“What kind of good man would want to place his assets, his assets at the disposal of legislation as open as Article 11 of the improbity law was? We reformed with courage, with more than 440 votes in the Chamber of Deputies and more than 70 votes in the Federal Senate. And this law has been discussed by injunctions in the Supreme Court”, he criticized.

The president of the Chamber said that, if there is no suitable adjustment, “the proposal of the National Congress is that we vote on a new law to make the legislation clearer and protect men and women of good faith and good mayors, municipal secretaries, governors and managers.”

“The law does not protect wrongdoing, it does not protect those who use deceit, nor does it protect those who enrich themselves from public assets. These are practically the law banning politics”, he continued. “But those who act in good faith, who suffer persecution, will be protected by law so as not to have their assets, nor their greatest political asset, which is their mandate, vilified at the hands of a more provocative action by the Public Prosecutor’s Office, as per example.”

Two months after the enactment of the new Misconduct Law, Lira went to court to ask, based on the new rules, for the annulment of a conviction that threatened her political rights.

Lira is convicted of impropriety for deviations in the Assembly of Alagoas in a process resulting from Operation Taturana, launched in 2007.

The case has been pending before the Judiciary for more than a decade. Today, it is under analysis by the STJ (Superior Court of Justice), after the conviction was confirmed in the first and second instances.
