government says company closures are “misinformation”

The Social Communication Secretariat of the Luiz Inácio Lula da Silva (PT) government released a note to denounce “pieces of misinformation” about the closure of app transport companies. The ministry claims that the false information would be having repercussions after the publication of the labor regulation project, as presented on Monday (4). The statement was published on the “Brazil against fake” page on the government website.

According to the note, the regulation of self-employment via platforms was discussed with companies and workers in a tripartite group made up of 45 members created by the Ministry of Labor and Employment and the “closing of platform companies of this kind in the country does not correspond to reality, a since the companies themselves participated in the process of creating the regulatory proposal already sent to the National Congress”.

After discussions on aspects inherent to the activities carried out through technological platforms, the note states, “workers and entrepreneurs were committed to finding common ground that meets the needs of drivers and, at the same time, enables the growth and sustainability of companies “.

The statement says that the platform companies participated in the signing ceremony for sending the message of the Complementary Law Project (PLP 12/2024) to Congress, by President Luiz Inácio Lula da Silva, and reaffirmed, at the event, “their commitment to investments in the country, at work, in the relationship with its employees and in the development of its business”.

It also lists the companies represented in the working group: Brazilian Mobility and Technology Association (Amobitec), iFood, Uber, Zé Delivery, Lalamove, Digital Innovation Movement (MID), Market Livre, Rappi, 99, inDrive, Market Livre, Rappi , Latin American Internet Association (Alai).

The trade unions that participated in the discussions were: Central dos Sindicatos Brasileiros (CSB), Central dos Trabalhadores do Brasil (CTB), Central Única dos Trabalhadores (CUT), Força Sindical (FS), Nova Central Sindical de Trabalhadores (NCST) and the General Workers Union (UGT).

On the government’s side, the federal bodies involved were the Ministries of Labor and Employment (MTE), Social Security (MPS), Development, Industry and Commerce (MDIC), Finance (MF), Justice and Public Security (MJSP ), the Civil House and the General Secretariat of the Presidency of the Republic and the Attorney General of the Union (AGU).

Government denies that driver will crash

“Misinformative content” is also being reproduced, according to the note, with false information that self-employed platform workers will start clocking out. The government says that the project preserves workers’ autonomy, “so that they are not obliged to choose a single platform to work on or to join a union. Another aspect is the flexibility that this work format allows, and that needed to be legally preserved.”

The minimum working hours were established jointly, says the government, to avoid excesses. “The maximum period of time a worker can be connected to the same platform cannot exceed 12 hours a day. To receive the national minimum wage, the worker must work 8 hours a day actually worked.”

The minimum values ​​for remuneration for the activity established in the project are R$32.09 per hour of work and remuneration of at least one minimum wage (R$1,412) and the employee’s contribution to the National Social Security Institute (INSS) will be 7.5%.

“In this way, the complementary bill thus manages to guarantee these workers the right to the minimum wage, fixed by law and nationally unified, provided for in item IV of Article 7 of the Magna Carta as a right of rural and urban workers”, says the government.

The project goes to the Chamber of Deputies, where it must be considered and voted on within 45 days and, if approved, it will go to the Senate, which will have the same time for evaluation and voting.
