Government of São Paulo will facilitate the payment of ICMS debts

The Legislative Assembly of São Paulo (Alesp) approved, on the night of this Wednesday (27), the bill that intends to facilitate debt repayment of the Tax on Circulation of Goods and Services (ICMS). Called “Solve Now”, PL 1,246/23 was proposed by the State Secretariat for Finance and Planning (Sefaz).
With the approval of the project, the São Paulo government intends to unlock amounts stuck in court. It is estimated that more than R$180 billion in ICMS fines are stuck in the Taxes and Fees Court (TIT), according to data from Sefaz. With the new legislation proposing discount and less bureaucracythe economic team of governor Tarcísio de Freitas (Republicans) hopes to encourage businesspeople to pay off debts without the need to go to court.
At Alesp, the project was approved by 56 votes in favor, of the 48 necessary. Other 14 parliamentarians voted against the proposal. Once again, the São Paulo government was unable to bring together all the deputies from the allied base, including two deputies from the PSDone of Republicans and three of PL remained in obstruction.
How will debt payments be made with Resolve Já:
- 70% if payment is made within 30 days, counting from notification of the infraction;
- 55% within 30 days, counting from the summons for the defense trial;
- 40% within 30 days, counting from the notification of the judgment of the appeal presented.
After 30 days of the infraction:
- 55% after 30 days of notification of the infraction, when no defense is presented. Installments in up to 36x: 40% in 37x or more: 30%;
- 40% after 30 days, counting from the notice of the defense trial, when no appeal is presented by the company. Installments in up to 36x: 30% in 37x or more: 20%;
- 30% after 30 days of notification of the judgment of the appeal presented by the company. Installments in up to 36x: 20% / 37x or more: 10%.
