GM cancels more than a thousand layoffs at factories – 11/04/2023 – Market

General Motors has decided to cancel the layoffs carried out at the factories in São José dos Campos, São Caetano do Sul and Mogi das Cruzes and will reintegrate the more than a thousand employees affected by the cuts, said the Metalworkers Union of São José dos Campos and Region this Saturday (4).

According to the entity, the company should hold a meeting on Monday (6) with the three unions involved in the negotiations, and the process of canceling the layoffs is already being carried out.

The announcement comes after the TST (Superior Labor Court) confirmed, on Friday (3), a decision by the TRT-15 (Regional Labor Court of the 15th Region) that determined that GM reinstated 839 workers laid off in São José dos Campos .

In her decision, Minister Dora Maria da Costa, from the TST, denied an injunction request from the automaker to maintain the cuts at the factory after the determination of the TRT-15.

When contacted at 12pm, General Motors did not respond until the completion of this text.

In total, more than a thousand workers were fired at the three GM plants: 839 at the São José dos Campos plant, more than 200 at the São Caetano do Sul plant and one hundred at the Mogi das Cruzes unit, according to metalworkers’ unions.

The layoffs took place on the 21st, when General Motors workers in São José dos Campos, Mogi das Cruzes and São Caetano do Sul were laid off.

According to the union, the notices were sent by telegram and email. The automaker confirmed cuts, but does not report the total number of employees laid off. At the time, the company said that the measure was taken because of the drop in sales and exports.

According to the union, according to the lay-off agreement, approved in June, around 1,200 workers at the unit should still have job security during the duration of the contract suspension.

This Friday’s TST decision confirmed the determination of reinstatement of employees, “with prompt reinsertion on the payroll (and maintaining all rights and conditions in force before the dismissals), from November 1, 2023”, as established by the TRT-15.

In the document, it had also been ordered that the company not lay off new workers without prior negotiation.

“Such determinations are made under penalty of a daily fine of R$1,000 per worker dismissed or not reinstated, reversible in favor of the respective represented, up to the limit of the current value of each person’s monthly salary”, says the decision.
