Free baggage: deputy wants to drop charge on flights – 03/27/2023 – Panel SA

Federal Deputy Beto Preto (PSD-PR) filed this Monday (27) a bill that could resurrect the tussle over charging checked baggage on air travel.

The parliamentarian argues that he wants to resume gratuity in the dispatch. In the airline industry, however, the assessment is that there is no such thing as free luggage, that is, even when there is no additional cost per bag, the passenger pays the shipping fee included in the ticket price.

The deputy proposes an amendment to the Brazilian Aeronautical Code to create a legal barrier against normative acts by Anac (National Civil Aviation Agency) that could overturn gratuity.

According to the text, bags up to 23 kg for domestic flights and up to 32 kg for international flights will be covered. For Preto, charging for bags that comply with weight and volume limits is abusive and Anac goes beyond regulatory power by allowing charging.

Despite stating that the intention of the project is not to annul decisions of other powers —Anac is a body linked to the Executive—, the bill aims to prevent the agency from creating rules on charging for baggage.

Last year, Congress tried to include an article on the subject in a provisional measure that changed rules in the aviation sector. Former President Jair Bolsonaro vetoed it on the grounds that the proposal was against the public interest, since the price of tickets would be revised by companies with increased operating costs.
