The Minister of Labor and Employment, Luiz Marinho, said this Thursday (16th), that he is creating a new FGTS rule so that workers who make the birthday withdrawal have access to the full value of the fund in case of dismissal without having to wait two years, as dictated by the current norm. The measure, according to him, will come into effect as of March and will cover resources that are not committed to financing in emergency cases for dismissal without just cause.

“What are we going to do right away? [fazer] it is to get the worker out of the trap, in which a dismissed person cannot withdraw his fund”, he said in an interview with SBT News.

The change, he says, does not need a new law and can only be taken by the Board of Trustees of the FGTS. On the other hand, the idea of ​​putting an end to the anniversary withdrawal, which he mentioned last Tuesday (14) in a meeting with the Federation of Industries of the State of São Paulo (Fiesp) needs a change in legislation by the National Congress or a provisional measure – which is not being discussed with President Luiz Inácio Lula da Silva (PT), he says.

Marinho also said that the changes will guarantee that all loan contracts granted by banks with the FGTS as guarantee will be respected. “It is evident that the banks will not default. We are discussing offering the worker to be the agent to tell the bank what the rule is and not the bank to say what the rule is. Was she fired? I will pay off the debt at once, ”he said.

Still according to the minister, the customer will be able to settle the loan at a discount, by anticipating the discharge. “Today, he can’t even withdraw his balance”. And he completed, saying that the government ministries “should not worry about the banks. Those who should be concerned about the banks are the banks themselves”.
