Electronic cigarette: Tax authorities define tax, but Anvisa vetoes it – 06/13/2023 – Panel SA

Anvisa is slow to regulate electronic cigarettes in the country, but the Federal Revenue has already defined the taxes to be charged on products known in the market as vapes or e-cigs.

For manufacturers who want to assemble e-cigs in the country, the Import Tax will be 9.6% and the IPI (Tax on Industrialized Products), 6.5%.

For importers of the finished product, the Import Tax will be 14% and the IPI, 10%.

The tax authorities are keeping an eye on this market, which moves BRL 7.5 billion in the country, equivalent to half of Acre’s GDP.

A study carried out by Fiemg, the industry federation of Minas Gerais, shows that the Union loses R$ 2.2 billion in taxes for not defining the rules of the market.

BAT and other global giants in the tobacco market want to build electronic cigarette factories in the country and, therefore, are trying to convince Anvisa (National Health Surveillance Agency) to hasten the regulation of these products, considered less toxic than conventional cigarettes .

The agency began reviewing the case four years ago and, until it renders its decision, has banned the marketing of so-called vapes or e-cigs.
