Court decrees bankruptcy of Pan, manufacturer of ‘cigarettes’ and chocolate ‘coins’

With the sentence, the activities will be closed, the goods will be sold, and the amount collected will pay the creditors. “Recognized as a persistent debtor of taxes and without her regularized registration, there is no way to consider the continuity of the activities of the company under recovery as possible”, wrote the judge. “In this vein, it should be remembered that for more than 20 (twenty) years the company under reorganization has not regularly collected its state taxes, a conduct that proves to be persistent and disloyal towards its competitors”, he said, in another excerpt. The company is 85 years old and has four branches. In October 2016, it was purchased by Grupo Brasil Participações. Earlier this month, officials spoke out in the process. They asked the Justice for another three months for a new judicial recovery plan to be presented and for bankruptcy not to be declared. On the last 10th, the company even filed for self-bankruptcy if it was not given a period of 90 days to take advantage of the Easter and Mother’s Day period to try to rebuild and settle debts. The trustee had stated in the case file that there was a need to declare bankruptcy. In a note, previously, the State Attorney General, responsible for the debts registered in the company’s active debt, said that Pan has more than R$ 126 million in registered debts. “Of this amount, R$ 125 million are declared ICMS debts, those previously recognized by the taxpayer itself. There is no formal request for payment in installments or transaction of debts within the scope of the PGE”, he added in the note. Currently, the staff is 52 people. The company said that revenues fell with the 2017 restructuring and that, during the Covid-19 pandemic, there was an even greater reduction. Tax debts must be paid with part of the machinery and real estate valued at around R$ 182 million. In October 2016, at the age of 81, Pan changed owners. The family candy business was acquired by Grupo Brasil Participações.
