Company goes to court to patent super medical marijuana – 07/11/2023 – Panel SA

After modified soy, famous for its resistance to climate variations and productivity, Brazil is now preparing to register its first turbocharged marijuana seeds with the Ministry of Agriculture.

The order will be made by Adwa Cannabis, the only national company authorized to cultivate commercially.

Along these lines, Embrapa (Brazilian Agricultural Research Corporation) has an agreement with Adwa to share information to support future public research on the subject, explains Rodrigo Mesquita, Adwa’s legal director.

There will be at least two patents: one for cannabis, together with the Department of Agronomy at the Federal University of Viçosa, and another for industrial hemp, at the Department of Engineering.

In the first case, essential oils are extracted for therapeutic purposes. In the second, the seed and the fibers from the stem of the plant are used for food and industrial purposes.

Although allowed by the Drug Law, cultivation has not yet been regulated by the Union. Therefore, it was necessary to go to court to obtain the right of registration and intellectual protection of the varieties of the species. The commercialization of medicinal products is allowed by Anvisa (National Health Surveillance Agency), but Justice has been granting permission for planting.

The records are the result of a partnership between the Federal University of Viçosa and Adwa Cannabis, a startup that invests in technologies related to the cannabis production chain. Embrapa has already signed an agreement with the company.

Adwa and the University were already working on the genetic improvement of four types of seeds supplied by Colombia to adapt to the climatic conditions in Brazil and with a higher concentration of THC and CBD, active principles for medicines used in the treatment of diseases such as anxiety, depression, insomnia , arthritis, and even Alzheimer’s and Parkinson’s.

According to Mesquita, the government has the authority to enact a law decree that regulates cultivation, providing more legal security for a market that is already established in the country.

Only one of the associations involved in this business already moves BRL 4 million per month.
It is estimated that there are 13 million patients in the country who would potentially use cannabis.
