Business community asks Haddad to end abusive fines at Carf – 06/21/2023 – Panel SA

Minister Fernando Haddad (Finance) and the president of the Council of Esfera Brasil, João Camargo, discussed this Wednesday (21) the creation of a committee to discuss changes in assessments by the Federal Revenue and Carf, the taxpayers’ appeals council.

The main proposal is the exclusion of interest and fines from the tax debt questioned by companies in the Carf. The fine alone increases the original value of the assessment by 150%. The claim is that interest will only be levied during the period.

In addition, the group asks for a period of 180 days to prevent the issue from being brought to court.

The committee would be formed by the rapporteur of the Carf bill (Council for the Administration of Tax Resources), federal deputy Beto Pereira (PSDB-MS), representatives of the Federal Revenue Service and the business community.

The agenda is a proposal from Esfera and Abrasca (association of public companies) to Minister Haddad. They had already been delivered to the head of the portfolio in February, shortly after the return of the casting vote, in favor of the government, in CARF.

Through a provisional measure, the casting vote returned to exist, breaking the judgment in favor of the Revenue.

The provisional measure, however, expired twenty days ago. The bill reported by Pereira maintains the casting vote, but the expectation is that the suggestions presented to Minister Haddad will be incorporated.
