BB (Banco do Brasil) was sentenced to pay R$ 23,300 to singer Lulu Santos for having inserted the artist’s name in the list of debtors of SPC/Serasa due to a debt of R$ 4,908.12.
According to the process, which ran at the 44th Civil Court of Rio de Janeiro, the debt would have been made through expenses with two cards issued in the name of the singer in the city of São Paulo.
The artist’s lawyers argued that, on the dates of the purchases, he was not even in the capital of São Paulo, nor was he aware of the existence of the cards issued in his name. He would have learned about the inclusion of his name in the debtor register only when he had denied the request for additional cards from Itaú.
Lulu Santos’ defense also said that, until his problem was resolved, the artist went through “several situations of embarrassment, not being able to use his card or request credit from the bank” and had his image damaged.
Of the amount of BRL 23,326.91 that BB was sentenced to pay, BRL 17,791.21 referred to moral damages and the remainder related to costs and attorney’s fees.
Sought, the singer’s press office did not return. BB confirmed the final and unappealable decision of the process and said that “it does not issue comments on judicial decisions.”
