Lawyer Denise Coelho explained that the payroll loan, when regularly contracted by the client, transfers to the bank the responsibility of collecting the loan installments from the public body, if the discount is not made on the date, the responsibility is not the client’s and if it is negative, it will be characterized as a failure in the provision of service by the bank.

“In the case of payroll loans, the discount is made directly at the body that pays the salary or benefit, that is, the money does not even enter the account of the public servant, retiree, pensioner or INSS beneficiary, who does not have the option of revoke such loan, being obliged to file such a demand if it does not recognize the discounts”,

explains.

Lack of communication

As a result of undue denial, according to Coelho, the customer may seek compensation in court for the damage suffered. “In the absence of payment, before making a negative, banks should communicate / notify customers to seek a solution, providing opportunities for debt payment, such as, for example, refinancing the loan, or other less harmful ways to the customer, than negation.”

Other cases that have been occurring are financial fraudsters who say they are going to renegotiate a debt with the bank. According to the lawyer, they claim that they will reduce their portion of the loan, but the information is false, causing great damage to the population, because these finance companies have nothing, they are just an individual micro-entrepreneur (MEI).

“The Amazonian consumer who checks these possible advantages offered by financial companies, should initially analyze whether this company actually exists, if the rates, interest and late payment are really positive for refinancing, to try to avoid possible scams”,
