Ayres Britto goes to the STF to defend the revision of the FGTS – 04/18/2023 – Mônica Bergamo

Former Minister of the STF (Federal Supreme Court) Carlos Ayres Britto started to act in the ADI (Direct Action of Unconstitutionality) that claims the revision of the FGTS (Guarantee Fund for Length of Service). The case was ruled and should be judged by the highest court in the country next Thursday (20).

The Supreme will analyze the action that questions the constitutionality of the correction of the money deposited in the fund. Currently, the FGTS return is 3% per year plus the TR (Referential Rate), which yields close to zero. With this, the update of money is below inflation.

Before the court, Ayres Britto will represent the National Association of Banco do Brasil Employees (ANABB), which defends the origin of the ADI and the exchange of the Referential Rate for another indicator.

The entity’s idea is to obtain a decision in favor of the revision and, with that, benefit Banco do Brasil employees and workers from all over the country. A document with the position prepared by Ayres Britto has already been handed over to all STF ministers.

ADI number 5,090 was presented in 2014 and requests that the values ​​of the Fundo de Garantia be accrued by an inflationary index. Among them are the INPC, used in salary readjustment negotiations, and the IPCA-E, which was the basis for the payment of government precatories until the end of 2021.

The action arose after the Supreme Court decided that the government could not use the Referential Rate to correct precatories. A study commissioned by the Solidarity party and by Força Sindical pointed out considerable losses to the worker. The survey showed that the correction of values ​​brought a loss of 88.3% to the money deposited in the FGTS from 1999 to 2013.
