The regulatory agency will allow the termination of contracts for the use of the national electricity system and generation grants, without imposing fines. According to Aneel, 292 enterprises showed interest in canceling the contracts. Most have not yet started construction. The plants are located in nine states: Minas Gerais, Bahia, Rio Grande do Norte, Piauí, Ceará, Mato Grosso do Sul, Goiás, Paraíba and Alagoas – in order of the amount of energy that would be inserted into the system. To have the terms canceled, companies cannot owe industry fees or keep legal proceedings on the subject. The plants already contracted by energy distributors need to cancel the contracts before joining the measure. Projects contracted by distributors will have the option of adhering to a termination procedure for contracts starting supply in 2025. Aneel will also allow the “regularization” of projects with a delayed schedule, even without justifications that exempt the plants from responsibility. The plants will be able to count on another three years for their implementation, as long as they regularize the payment of due fees and undertake not to file lawsuits. The proposal intends to solve a bottleneck in the electric power system. In 2021, Congress established the end of 50% to 100% discounts on tariffs for the use of distribution and transmission systems for biomass, wind and solar energy plants. Companies had until March 2022 to ask Aneel for authorization to build the plants and enjoy all the benefits. After that period, subsidies would be reduced following a schedule defined by law. When requesting the connection, the plants should present to the agency an access information document, issued by the National Electric System Operator (ONS) and which proves the authorization for connection to the energy transmission facilities — without being connected, it is not possible to sell the energy produced to consumers in other locations. But a decree by then-President Jair Bolsonaro (PL) of December 2021 determined that the agency no longer required the document. This intensified the “gold rush” to obtain generation permits, mainly for solar and wind power plants, but without the guarantee that they could sell the energy when they started operating. “The ones who provoked the ‘gold rush’ were the agents. Especially agents who knew that their ventures had no viability. None. They did that just to keep the discount on the use of the network”, said director Hélvio Guerra, in early June , when the process began to be discussed.
