Americanas: MPT and Minister of Labor participate in mediation between company and unions

The MPT initiated the mediation procedure this month, after workers’ representatives expressed concern for the more than 40,000 Americanas employees during the judicial recovery process. The company, which tries to settle debts of R$ 43 billion, reiterated a commitment signed by Americanas in a meeting with the unions not to carry out major layoffs until the approval of the judicial recovery plan. The presentation is scheduled for March 20. The unions ask that the eventual labor restructuring plan be anticipated to the entities for evaluation and that dismissals are always approved. “The existing scenario suggests that dialogical, sincere and transparent confrontation between public institutions, the company and the unions is the best way to handle the issue”, said in a note Gérson de Lima, from the MPT. The news left the market in an uproar and caused the then president of the company, Sergio Rial, and the director of investor relations, André Covre, to leave the company less than 10 days after being sworn in. The company filed for judicial recovery, which was accepted on the same day by Judge Paulo Assed Estefan, of the 4th Corporate Court of the Judicial District of Rio de Janeiro. The company is now in the so-called “shielding period”, a period of 180 days in which all its debts are suspended. Also in January, the company requested, in the United States, the extension of the request for protection against creditors, to suspend payments due in that country. Recently, the company also ended the telephone sales service and interrupted a series of contracts with third-party suppliers, and asked the Court that energy and telecommunications concessionaires be prevented from suspending services provided to Americanas – which delayed their payments to them.
