Americanas asks for another 48 hours to deliver list of creditors – 01/23/2023 – Market

Americanas, one of the largest retailers in the country, which officially entered into judicial recovery last Thursday (19), requested an additional 48 hours to the Court to deliver the list of creditors, the company found out. Sheet.

In the request for judicial recovery made on Thursday, granted on the same day by Judge Paulo Assed Stefan, of the 4th Corporate Court of the Judicial District of the Capital of the State of Rio de Janeiro, the company reported debts of R$ 43 billion with 16,300 creditors , which constituted the fourth largest judicial recovery in the country’s history (behind only Odebrecht, Oi and Samarco).

The judge then gave the company 48 hours from the date of the decision, which was only issued the following day (20), for the company to deliver the list of creditors. Not counting the weekend (not included in court decisions), the company should deliver the list to Justice this Tuesday (24).

But the company informed the TJ-RJ (Court of Justice of the State of Rio de Janeiro) that it only had access to the decision on Saturday (21st), because of the São Sebastião holiday, celebrated last Friday (20th), in Rio, the company’s headquarters.

“The decision was issued on 1/19/2023, at 5:23 pm. The notification of said decision was issued on 1/20/2023, while the reading was carried out by the Americanas Group on 1/21/2023, at 18:31”, says the retailer in the petition in which it tries to extend the deadline.

In its justification, the company says that the additional deadline, to deliver the list this Wednesday (25), does not imply any damage to creditors.

The judge has not yet appeared, but should do so today, found the Sheet.

“The first list of creditors presented by the debtor can always be adjusted”, says lawyer Filipe Denki, specialist in judicial recovery at Lara Martins Advogados. “Then, the credit verification phase begins, where all creditors will have a period of 15 days to present any differences before the trustee”, he says.

After verification of credits by the trustee, says the expert, a second list of creditors is published, subject to credit challenge, which must be made within the next ten days. “The creditors who disagree with this second list may present a credit challenge, or even delayed credit authorization, until the general framework of creditors is consolidated, which is called the definitive list.”

Until this “definitive list” is presented, says Denki, the process could take months.
