Robinho’s defense asks the STJ to translate the entire process in Italy

The defense of ex-striker Robinho asked the STJ to demand that Italy send the entire process (and translated) that led the player to be sentenced to 9 years in prison for the rape of a woman in Milan.

In a document filed this Thursday afternoon (16), the office of lawyer José Eduardo Alckmin states that it cannot defend its client without having access to the entirety of the Italian process, which included all the documents and evidence produced by the police, by the Ministry Public and by the Justice of Italy.

In the request for Robinho’s sentence to be transferred to Brazil, the Italians sent only the sentence, along with a sworn translation, which is customary in these cases. But Robinho’s lawyer says that the court must analyze the process as a whole to verify that the Brazilian was treated fairly in Europe.

“The request of the Government of Italy is lacking due instruction, as the copy of the original process and its respective translation are missing, making it impossible to exercise the right to full defense”, Robinho’s lawyers state in the document.

The request by Robinho’s lawyers is based on an article of the internal rules of the STJ, according to which the request for transfer of sentence must be accompanied by the foreign sentence translated into Portuguese, as well as “other indispensable documents”. In the understanding of the former player’s defense, the entire process, with papers produced over ten years, would be an indispensable document.

Minister Maria Thereza de Assis Moura, president of the STJ and responsible for the case, has not yet decided whether to accept Robinho’s request.
