Judge Agostino Silvério, from the Court of Justice of Amapá (TJAP), granted a request from the Public Ministry (MP-AP) for the records of the Operation Cartas Marcadas process to be sent to the Electoral Court (JE). The decision took place this Wednesday (2).

The operation investigates a criminal organization that, under the command of the mayor of Mazagão, João da Silva Costa, known as Dudão, embezzled, according to the Public Ministry, more than R$200 million. In addition to the mayor, businesspeople and city hall employees are defendants in the action, totaling ten people, including relatives and a sister of the mayor.

Through prosecutor Paulo Celso Ramos, the MP petitioned the case, stating that the precautionary measure should follow the Criminal Inquiry 0008074-19.2022.8.03.0000, and should, therefore, be sent to the Electoral Court, given that it is connected with Operation Marked Letters.

In the decision, the judge, who is the rapporteur of the Operation Cartas Marcadas process, noted that the MP’s request should be granted, given that, in this specific case, it is an investigation in which several illicit practices that were taking place were alleged. within the municipality of Mazagão and would directly involve mayor João da Silva Costa, family members of the municipal manager, businesspeople and employees of Mazagão city hall.

Silvério cited a precedent from the Federal Supreme Court, formed by its Plenary in the judgment of Inquiry 4435 AgR-Quarto/DF, moving towards the Electoral Court being competent to judge electoral crimes and common crimes related to them, adding that jurisprudence recognizes competence in favor of the Electoral Court.

For judge Agostino Silvério, although electoral crimes are not formally narrated in the accusatory piece, there is no way to affirm their non-existence.

The Public Prosecutor’s Office itself clarifies in the complaint that there was “a group managing political support and payments to parliamentarians (…) which had the task of helping the gang leaders to gain and buy political support, deliver bribes to parliamentarians and representatives of political parties ”.

“In this sense, having verified the competence of the Electoral Court to understand the context presented in the present case, given the connection with electoral crimes, the case must be sent to that body, as the inquiry 0008474-19.2022 has already been sent and received. .8.03.0000, on September 25, 2024, according to proof of receipt of a letter from the Regional Electoral Court of Amapá. In view of the above, I grant the request of the Public Ministry for the files (Operation Cartas Marcadas) to be sent to the Electoral Court”finished Agostino Silverio.
