MP adopts measures against the use of fireworks at political events in AM
To ensure, in a preventive manner, the preservation of the health of elderly people and groups vulnerable to damage caused by the release of fireworks at rallies – especially people with Autism Spectrum Disorder (ASD) -, the Electoral Public Ministry, through the electoral prosecutor’s office of the 6th Electoral Zone, issued recommendations to political parties and candidates in the municipalities of Anamã, Caapiranga and Manacapuru to refrain from this practice in electoral campaigns.
The measures were based on article 7 of Resolution 23.610/2019 of the Superior Electoral Court, which considers advertising that disturbs public peace, such as noise, sound instruments and fireworks, to be an abusive practice, since these objects can reach 150 to 175 decibels — double the 80 decibels permitted by the electoral code.
In the actions, the Public Prosecutor Tânia Maria de Azevedo Feitosa, from the 6th Electoral Zone, cites the study developed by the World Health Organization (WHO), which shows that, on a scale, the human ear can tolerate noises of 120 to 140 decibels and, if this limit is exceeded, there is a possibility of causing harm to health.
“For children and people on the autism spectrum, fireworks can trigger sensory overload, leading to adverse reactions. The loud noise is overwhelming, causing stress and anxiety. Meanwhile, the bright lights and unpredictable pops result in aversive sensations because they are disturbing,” he said.
Still in the documents, the prosecutor mentions the decision of the Federal Supreme Court, which legitimizes municipalities to approve laws that prohibit the use of pyrotechnic devices and the Municipal Law of Manacapuru 1313/2023 which prohibits the handling of fireworks with a bang, allowing the handling only of fireworks without noise.
Measure in Coari
In Coari, the Public Prosecutor Bruno Escórcio Cerqueira Barros, head of the 8th Electoral Zone, issued recommendation no. 2024/0000098540, also intended for parties and candidates participating in the 2024 elections, so that they do not use loud fireworks in their campaign-related events, a measure that applies to both public and private environments.
The recommendation, which establishes a limit of 85 decibels for all noise produced by vehicles, speakers and other sound instruments, is valid for the entire period of the electoral legislation, in addition to requiring entities to express awareness of compliance with the recommendation, under penalty of legal measures being implemented.
