The Minister of the Federal Supreme Court (STF), Ricardo Lewandowski, annulled the contract for the assignment of use under special conditions for the Island of Fernando de Noronha, signed between the Union and the State of Pernambuco in 2002.

According to the minister, the annulment of the assignment contract currently in force is a necessary step for the ratification of a new agreement to be ratified between the Union and Pernambuco, for the integrated management of conservation units in the archipelago. Lewandowski also claims that the nullity stems from the fact that the contract was entered into without authorization from the Legislative Power.

Last Friday, Lula’s government signed an agreement with the State of Pernambuco to try to create shared management of the Fernando de Noronha Archipelago. The new agreement goes against former president Jair Bolsonaro’s attempt to federalize Noronha. In March 2022, AGU filed a lawsuit with the STF so that Noronha would not be part of the State of Pernambuco.

As the issue involves a federative conflict of great repercussion for the Union, the state and also individuals, Lewandowski asked the president of the STF, Minister Rosa Weber, to convene an extraordinary session of the Virtual Plenary, for collegiate deliberation on the subject.
