The Court of Justice of the State of São Paulo overturned an injunction that prohibited the removal of tents and homeless people in the capital, which had been obtained by federal deputy Guilherme Boulos (PSOL-SP).
“Although the situation of hypervulnerability of homeless people in the city of São Paulo (and many others in this State and the entire country) is very serious, whose physical and moral integrity must be preserved (not just in the cold letter of the law), the exercise of substantive right must be postulated according to appropriate procedural rules”, says the decision of the judge Ribeiro de Paula.
The injunction obtained by Boulos in February prohibited the City of São Paulo from removing tents from homeless people during the day.
The measure had been taken by Mayor Ricardo Nunes (MDB) on the grounds that the tents interfered with the right to come and go for people from São Paulo, in addition to causing cleaning problems.
Boulos and Nunes must face each other in the mayoral election next year.
