In search of consensus, Revenue opens service channels to guide taxpayers and avoid disputes



Federal Revenue launched two programs this Tuesday, “Receita Soluciona” and “Receita de Consenso”. The agency has sought to change its focus from punitive action to a guiding way of acting. The Federal Revenue Secretariat announced this Tuesday (1st) two new programs to facilitate dialogue with taxpayers, seeking to guide them regarding their understanding of current legislation, and, thus, avoid disputes in the administrative and judicial spheres. . To this end, two programs were launched, “Receita Soluciona” and “Receita de Consenso”. “The taxpayer can come in, debate and discuss, and in the end say that they do not want to participate. There is no sanction in relation to this”, stated the Secretary of the Federal Revenue, Robinson Barreirinhas. He reaffirmed that the body has sought to change its focus from punitive action to a guiding way of acting. “Since last year we haven’t had any major inspection operations, we’ve had major guidance operations,” he said. Barreirinhas recalled that the bill that seeks to establish a cooperative relationship between the Federal Revenue Service and taxpayers – and distinguish good payers (who can count on benefits), has not yet been approved by the Legislature. He explained that the programs launched this week seek to advance, even before analyzing the project, the relationship with taxpayers who have a good evaluation by the Federal Revenue Service. Revenue Soluciona The secretary informed that “Receita Soluciona” will function as a “VIP channel” for dialogue with national confederations representing economic categories; trade union centrals; and national class entities. He cited, for example, the Federal Accounting Council (CFC), the Brazilian Bar Association (OAB) and the National Confederation of Industry (CNI). “We are opening this space so that these entities have a VIP channel for dialogue, encouraging them to be increasingly partners”, said Barreirinhas, from the Federal Revenue Service. According to him, the objective of the program is always to seek to avoid litigation. “Let us start thinking about publishing joint regulations with these bodies”, he added. The application protocol will be made through the Federal Revenue Digital Services Portal, using gov.br identification. The following will be discussed within the program: Matters with a specific procedural process; Arguing the constitutionality of a law or treaty; Request for information that can be obtained through the Access to Information Law; Assistance and procedural progress relating to specific taxpayers; Complaints. Consensus Revenue The other program launched this Tuesday will seek to offer taxpayers a “defender” within the Federal Revenue, who will work autonomously. It will be like the “ombudsman” of a large newspaper, who receives criticism from readers and seeks to act impartially to resolve conflicts, explained Secretary Barreirinhas. “With this change of stance from the punitive Revenue to the guiding Revenue, some channels of dialogue have to be built. It is a facilitator of dialogue. Not only are we no longer avoiding dialogue with the taxpayer, which was a stance for decades, but we are going to encourage this dialogue. Make the dialogue more fluid before there is litigation”, said the secretary. According to the agency, entry into Consensus Revenue is permitted for taxpayers with high classification in Compliance Incentive Programs. What may occur in these cases: a tax procedure, if there is a divergence, in the tax procedure, between the understandings of the inspection and the interested party without a tax procedure, if there are doubts regarding the tax consequences of a specific legal transaction of the interested party.
