Group of STJ ministers gives lecture and tourism in Europe – 05/29/2023 – Frederico Vasconcelos

Seven ministers from the STJ (Superior Court of Justice) will be in Italy this week to discuss judicial recovery and bankruptcy in a luxurious hotel on the shores of Lake Maggiore, in Milan.

Organized by Ibajud (Brazilian Insolvency Institute), the Milan Forum 2023 will take place on June 1st and 2nd.

The program foresees the presence of João Otávio de Noronha, Ribeiro Dantas, Marco Buzzi, Moura Ribeiro, Sebastião Reis, Villas Boas Cueva and Gurgel de Farias.

Ibajud is a civil association governed by private law. It is a lobby of law firms, court auctioneers, ranchers, agribusiness companies, court administrators and credit recovery firms.

“How can you trust justice in the STJ and STF if some ministers are practically every fortnight at an international event?”, says the judge Alfredo Attié, president of the São Paulo Academy of Law.

In early April, five STJ ministers, accompanied by women, celebrated Minister Ricardo Lewandowski’s birthday at the George V hotel in Paris.

They were in France, invited by the magazine Justice & Citizenship, at an event at the University of Paris. The editorial board is chaired by the national justice inspector, Luis Felipe Salomão.

Earlier this month, eight STJ ministers went to Italy for a meeting promoted by the OAB and the Sapienza University of Rome.

The former president of the STJ Humberto Martins gave a master class on corporate insolvency in Seville, Spain. The meeting was organized by Judge Daniel Carnio, from TJ-SP, former academic coordinator of Ibajud.

Carnio was an auxiliary judge of the National Justice Department (2018/2020) and an auxiliary judge of the presidency of the STJ (2020/2022). The STJ referred him to the CNMP.

He has already taken Minister Alexandre de Moraes, from the STF, to talk about judicial recovery in San Diego, California (USA). Last February, he spent five days in Tuscany, Italy. He organized debates at the University of Pisa, on constitutional law, and at Siena, on the actions of Bolsonaristas.

In 2018 he was elected jurist of the year by the Order of Economists of Brazil. His long stay outside the judicial activity is criticized. In 2022 he went to seminars in Spain, Italy, France and Argentina.

Carnio is a member of the Paulista Academy of Law.

Last year, despite Covid, between April and July these STJ ministers were at seven events: in Lisbon (two), Porto, Coimbra and Algarve. They also participated in meetings in Paris and São Paulo.

The “Forum Ibajud Algarve 2022” ended with dinner and a show at a casino.

This route was opened in Portugal by IDP, Gilmar Mendes’ institute, and FGV. At the end of June, the IDP will hold a new edition of the Lisbon Legal Forum.

Who organizes the event in Milan is Márcio Chaer, director of the magazine Consultor Jurídico. The meeting has the support of the Brazil-Europe Integration Forum (Fibe).

João Otávio de Noronha, the president of Ibajud, Rodrigo Quadrante, and the president of Fibe, Vitalino Canas, from the University of Lisbon, will be at the opening table.

Maria Thereza de Assis Moura, president of the STJ, and Rosa Weber, president of the CNJ, do not participate in convescotes. Rosa Weber and Luis Roberto Barroso traveled to Israel with the then president of the STF, Dias Toffoli, on an official visit. Five ministers from the STJ accompanied the delegation. Weber and Barroso paid their expenses. Toffoli and assistants received per diems. The STJ did not provide information.

When the STF sentenced deputy Daniel Silveira (PTB-RJ) to prison, Gilmar Mendes and André Mendonça voted remotely. They were in Lisbon, at a seminar of the Brazil-Europe Integration Forum.

No participant in the Milan Forum is paid for participating, informs Chaer.

When he presided over the CNJ, Lewandowski made the fees paid to magistrates for lectures confidential.

“Ibajud does not offer any lobbying returns to its sponsors,” said lawyer Rosely Cruz, founder of the institute, in 2018.

The offices of the STJ ministers did not provide information about the Milan Forum.
