Felipe Neto is sentenced for calling Lira excremental – 09/30/2024 – Power
The Federal District Court ordered YouTuber Felipe Neto to pay R$20,000 to the President of the Chamber, Arthur Lira (PP-AL), for moral damages. Lira joined the action after being called by the YouTuber “excremental”. The decision is this Monday (30), and can be appealed.
In April, Neto participated in a Chamber of Deputies seminar on the regulation of digital platforms and criticized Lira’s actions regarding the processing of the Fake News PL.
“It is possible that we will change the perception of bill 2,630, which, unfortunately, was crushed by the excremental Arthur Lira”, he said at the time.
The action was filed by the Chamber’s Parliamentary Prosecutor’s Office, the body responsible for defending the House and its representatives. Initially, compensation of R$200,000 was requested for moral damages as compensation for the crime of insult, but judge Cleber de Andrade Pinto, from the 16th Civil Court of Brasília, determined the value of R$20,000.
The judge justified this amount by considering the amount requested by Lira’s defense as “exaggerated and representative of illicit enrichment”. “Values at the level intended by the author are set in processes in which intense suffering caused to the victim is discussed, usually involving the loss of a loved one”, says the document.
In the decision, the judge says that Felipe Neto did not use the expression “in the heat of the moment”, but that he intended to address the President of the Chamber in an “injurious way, aiming to harm his honor and image”.
He states that the YouTuber even published a video of his speech on social media, following the repercussions of the case, which showed his “injurious intention”. “It aimed to harm the parliamentarian’s honor and image. It did not criticize the parliamentarian’s political performance, but it offended him personally”, says the decision.
When contacted, Neto’s advisor said that the YouTuber’s legal team had not yet been summoned. “When this occurs, it will make the appropriate decision on the appeal adopted”, he stated, in a note.
In July, the Federal Court in Brasília archived an investigation request made by Lira against Felipe Neto for the same “excremental” statement. Judge Antônio Claudio Macedo da Silva, 10th Federal Court of the Federal District, considered that there was no just cause for the process to continue and that the offense to the honor of others in the demonstration had not been proven.
