He was ineligible until 2028 for abuse of political power

Judge Márcia Santos Capanema de Souza, from the 23rd Electoral Zone of Rio de Janeiro, decreed the impeachment of the mandate of federal deputy Marcelo Crivella and his ineligibility until 2028, for abuse of political power in 2020. At the time, Crivella was mayor of Rio and sought re-election.

Justice considered that he abused his political power by using municipal public servants to prevent the work of journalists who covered the situation of municipal health services during the covid-19 pandemic.

According to the judge, the use of these servers violated the citizens’ right to information and freedom of the press “in view of the interest of avoiding the negative repercussion of that information on the candidacy for re-election” of the then candidate.

On her social networks, Crivella published a note released by her party, the Republicans. In the note, the party says that the decision, of May 8, does not have immediate effect and that, therefore, Crivella remains a federal deputy.

Republicanos also states that the removal of the mandate of a federal deputy is not up to an electoral judge of first instance who, according to the party, “does not have legal competence for this, above all, because the facts, object of the process, refer to to the 2020 election”.

The party said it was confident that the appeals already presented to the Regional Electoral Court (TRE-RJ) will be “duly analyzed, considering the appropriate instances of the process”.
