The recent decision of the Superior Electoral Court (TSE) to revoke the candidacy of federal deputy Deltan Dallagnol (Podemos-PR) will be debated this Tuesday (30) by the Financial Inspection and Control Commission of the Chamber of Deputies.

The request was made by deputy Kim Kataguiri (União-SP). According to the deputy, “it is important to point out that most of the biggest names in law consider the annulment of registration illegal and without precedent”.

Prominent names in the national judiciary, such as the retired minister of the Federal Supreme Court (STF), Marco Aurélio Mello, were invited. Marco Aurélio, who has chaired the Superior Electoral Court three times, even declared that he was “perplexed” by the decision of the electoral court. For the TSE, Dallagnol tried to circumvent the Clean Record Law by asking for the dismissal of the prosecutor to run for the 2022 Elections.

In an interview with Folha de São Paulo, the retired minister stated that the interpretation of the TSE occurred “outside the legal order”, since there was no Administrative Disciplinary Process (PAD) against Dallagnol, the federal deputy with the most votes in Paraná in recent years. elections. He received 344,917 thousand votes, well ahead of the runner-up, Gleisi Hoffmann (PT), who had around 261.2 thousand.

Deltan Dallagnol, who commanded the Operation Car Wash task force, said that the court invented an “imaginary ineligibility” to impeach him and that this was done out of revenge. “As time goes by, the system is taking revenge, retaliating against those who dared to fight corruption in Brazil,” he said.

The deputy was officially notified of the TSE’s decision last week, through the Official Gazette, with a five-day deadline to present a defense to the Chamber’s Internal Affairs, which should occur on Tuesday (30). After the end of the procedure, the process is forwarded to the Board of Directors of the Chamber which, according to the Constitution, is the body responsible for declaring the loss of mandate.

Jurists Ives Gandra Martins and Miguel Reale Júnior, in addition to other big names in law, are among those invited to the debate, scheduled for this Wednesday (30th), at 2 pm, at the Financial Inspection and Control Commission.
