No voter can be arrested from this Tuesday (1st) until October 8th except in three cases: flagrant arrest, criminal conviction for a non-bailable crime or failure to comply with safe conduct.
Examples of non-bailable crimes include racism, torture, drug trafficking and terrorism.
The restriction on arrests was already valid for candidates since September 21st, fifteen days before the first round. Until the 8th, they can only be arrested in the case of a flagrant crime.
According to the Electoral Code, “in the event of any arrest, the prisoner will be immediately taken to the presence of the competent judge”, and the magistrate will assess the legality or otherwise of the detention.
The measures aim to prevent undue interference in the fairness of the election and ensure the right to vote and be voted for.
The 2024 election is scheduled for the first Sunday of October, the 6th. Voting starts at 8am and goes until 5pm Brasília time. The second round takes place, in cities where there is one, on the 27th of the same month.
The election will define mayors and councilors across the country. Voting will take place in more than 5,500 cities and will mobilize more than 150 million voters, according to the TSE.
