Bill 1790/24 makes it a crime to disseminate false information related to a public calamity with the aim of misinforming the population, causing commotion or harming humanitarian actions.

The text, under analysis in the Chamber of Deputies, amends the Penal Code to further define that the penalty will be imprisonment, from one to four years, and a fine. This penalty will be increased by half if the crime is committed by a public agent or politician.

“The dissemination of fake news at these times can cause panic, undermine the effectiveness of response actions and even put lives at risk”, said the author of the proposal, deputy Helder Salomão (PT-ES).

Next steps

The project will be analyzed by the Constitution, Justice and Citizenship Committee and will then go to the Plenary.

To become law, it will also have to be approved by the Chamber of Deputies and the Federal Senate.
