Agencies charge ANS for canceling health plans – 09/30/2024 – Panel
With no solution in the Legislature in sight, the Federal Public Defender’s Office, Idec (Consumer Defense Institute) and Procon-SP (Consumer Protection and Defense Foundation) sent a letter to the National Supplementary Health Agency demanding urgent measures against the unilateral cancellation of plans collective health.
The letter was sent last Friday (27). In the document, the body and entities suggest the presentation of a work plan to prioritize problems with plan cancellations and that the ANS adapt its systems to better detail data on relationships and contracts, indicating, for example, the need for treatments continued by beneficiaries.
They also defend the creation of compulsory notification, so that operators can inform the agency when they make unilateral cancellations. Furthermore, they want to hold a public hearing on the topic.
“It should be noted that if such notification was already in progress, the ANS would have control over the types, quantities of links, contracts and beneficiaries and actions of health plan operators identified for undue cancellations and, even, through risk selection” , indicate in the letter.
The document criticizes the unjustified end of contracts in collective health plans at the initiative of operators. “In many cases, this abusive practice has affected people in extremely vulnerable situations, such as elderly people, people with disabilities, atypical children or those with ongoing therapy”, they write.
